Applicability. These terms and conditions apply between you and CaluTech
Air Corp. with respect to your purchases of products ("Products").
These terms and conditions shall apply and not be altered without the
express written permission from CaluTech.
Sales from the Internet Purchase Page are limited to Customers who
are at least 18 years of age.
Shipping. CaluTech reserves the right to select alternative carriers
for shipments. Shipping charges are invoiced according to terms below...

Payment terms. Credit card is the only form of payment that will be
accepted for Product orders on the Internet Purchase Page or you can
choose PayPal. We accept the following methods of payment: VISA, MasterCard,
or Discover. We will accept orders made by electronic
or mail-in check, but your check must clear
before shipping occurs. All orders received are subject to acceptance
by CaluTech in our sole discretion. All processed orders are subject
to inventory availability. CaluTech is not liable for delay in product
shipment. Orders submitted to us are secure through 256 bit Secure Socket
Layer encryption (SSL) for security and insured up to $10,000 per transaction. Phone
and mail-in orders are also accepted.
Sales Tax. CaluTech is required by law to collect all applicable sales
tax. Customer authorizes CaluTech to add sales tax to the credit card
submitted to us if customer is an Illinois resident (9.75%).
Time In Transit Damage Claims. Ownership of each product belongs to
you, the Customer, once package is picked-up from the CaluTech distribution
facility. Any damage or loss which occurs during transit will be covered
by CaluTech unless damage or loss occurs during package transit when
the package is shipped by a carrier selected by the Customer. Our standard
shipping company is United Parcel Service.
Warranty. CaluTech warranties are limited to those set forth in the
printed instructions and/or user manuals included with each order. For
questions regarding warranties or warranty claims please call or email
us.
Returns. Merchandise must be in unused condition and in original packaging
material. Original shipping charges are not refunded (if charged - shipping
is usually free). Re-stock fee of 15% applies to returns.
Defective merchandise will be exchanged for same or similar products
if they are under warranty. Refunds are not given for any warranty claims
or defective merchandise. Returned products with missing items are not
accepted.
Limitation of Damages & Liability. CaluTech is in no way liable
to any Customer for any special, incidental, consequential or punitive
damages, or for any claim by any third party. Customer agrees that for
any liability related to the purchase of any Products, CaluTech is not
liable for any amount of damages above the aggregate dollar amount paid
by Customer for the purchases under this agreement.
Reservations & Exceptions. CaluTech reserves the rights to adjust
pricing on its products without notice. In addition CaluTech reserves
the right to modify terms, specifications and warranties for Products
on the Internet Purchase Page at any time without notice. Any errors
in Product specifications, descriptions, and pricing are subject to
correction by CaluTech. CaluTech reserves the right to reject any order
that is not consistent with these terms & conditions or CaluTech's
sales policy guidelines.
Governing Law. All CaluTech owned Websites, including the Internet
Purchase Page, are operated and administered by CaluTech from its offices
in the State of Illinois, U.S.A.. This agreement and any sales hereunder
shall be governed by the laws of the State of Illinois. Customer agrees
to submit to the jurisdiction and venue of the federal or state courts
of the State of Illinois, County of Cook, for any disputes, claims or
causes of action involving this Internet site, the Internet Purchase
Page, or these terms & conditions. Customer and/or Website visitors
agree to abide the laws of the United States and any applicable state
laws. No representations are made that this Internet site the Internet
Purchase Page, or any CaluTech Website information or materials, products
or contents are appropriate or available for use outside the United
States of America.
